LHTC Internet Service (LHTC)
Acceptable Use Policy

In order to provide high quality customer service and to insure the integrity of your use of LHTC, we have adopted an acceptable user policy for LHTC customers. Please read this acceptable use policy prior to accessing LHTC Internet Service. By using or continuing to use LHTC, you agree to the terms of this policy. LHTC reserves the right to immediately terminate your account without notice at our sole discretion, if you or others who use your account violate this policy. LHTC also reserves the right to immediately remove any material or information, which violates this policy for any reason, whatsoever at our sole discretion without prior notice.

LHTC is designed for personal and family use within a single household and limited commercial activity. You may not resell or distribute LHTC outside your household or business. You may set up one: (1) Web page per account for personal use only using LHTC, but you may not establish a web page using a server located at your home. You agree that you will not use, nor allow others to use, your home computer as a Web Server, FTP Server, file server or game server or to run any other server applications.

You agree that you will not use, nor allow others to use, LHTC:

• to violate any applicable federal, state, local or international laws.
• to commit a crime, act of terrorism, or fraud, or to plan, encourage or help others to commit a crime or fraud, including but not limited to, acts of terrorism.
• to send or receive any information, which infringes the patents, trademarks, copyrights, trade secrets or proprietary rights of any other person or entity. This includes, but is not limited to digitization of music, movies, photographs or other copyrighted materials or software. LHTC complies with the Digital Millennium Copyright Act of 1998.
• to transmit any material that threatens or encourages bodily harm or destruction of property or which harasses, abuses, defames or invades the privacy of any other person or entity.
• to harm or attempt to harm a minor, including but not limited to using LHTC to send pornographic, obscene or profane materials and you agree to monitor and be completely responsible for the conduct of any minors who use your account.
• to send unsolicited advertising (including but not limited to mass or bulk e-mail), promotional materials or other forms of solicitation ("spamming"). We reserve the right, in our sole discretion, to determine whether such posting or transmission constitutes an advertisement, promotional material or any other form of solicitation.
• to upload or post any files, text or data anonymously or under a false name.
• to access the accounts of others or to attempt to penetrate security measures of LHTC or other computer systems ("hacking") or to cause a disruption of service to other on-line users. You agree that you will not use, nor allow others to use, tools designed for compromising network security, including but not limited to, password guessing programs, cracking tools, packet sniffers or network probing tools.
• to disrupt network or computer equipment owned by other customers. You also agree that you will not use, nor allow others to use, LHTC to disrupt other Internet Service Providers or services, including but not limited to e-mail bombing or the use of mass mailing programs.
• to intentionally transmit computer "viruses," worms, "Trojan horses" or other harmful software programs and that you will use your best efforts to prevent the unintentional transmission of such viruses or other harmful software.

Payment
You agree to pay a monthly recurring charge for the service. You agree to pay all applicable federal, state and local fees or taxes. LHTC reserves the right to change the amounts of fees and charges from time to time at its sole discretion upon thirty (30) days notice. Monthly charges are due in advance upon receipt of your bill. A late fee, collection and other costs associated with collection activity may be assessed for any delinquent account. LHTC may terminate service for any past due account. Should service be terminated for non-payment, a reconnect fee may be charged. You will be responsible for all expenses incurred by LHTC in collecting any unpaid amounts due in accordance with this agreement. Any billing discrepancy must be brought to LHTC in writing within sixty (60) days of its appearance on your bill.

CHARGES FOR ONLINE SERVICES OR TRANSACTIONS
By using LHTC Internet service, you may access information, products, and services for which there is a charge. You agree that all such fees or charges for on-line services, products, or information are your sole responsibility and not the responsibility of LHTC. You are also responsible for the protection of the security of your credit card or other financial information from unwanted or unauthorized transactions.

LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (WHETHER TORT, CONTRACT OR OTHERWISE) SHALL LHTC BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR BUSINESS INTERRUPTION, COMPUTER FAILURE OR MALFUNCTION, LOSS OF PROFITS, GOODWILL OR INFORMATION, OR ANY OTHER PECUNIARY LOSS OR DAMAGE) ARISING OUT OF OR RELATING TO LHTC SERVICE (INCLUDING, WITHOUT LIMITATION, USE OR INABILITY TO USE THE SERVICES), EVEN IF LHTC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL LHTC's CUMULATIVE LIABILITY TO CUSTOMER EXCEED THE SERVICE CHARGES PAID BY CUSTOMER TO LHTC FOR THE SERVICE DURING THE TWO (2) MONTHS IMMEDIATELY PRECEDING THE EVENT FOR WHICH LIABILITY IS CLAIMED.


Neither LHTC nor its Information Providers are responsible for any damages or injuries arising from customer's use of LHTC or inability to use LHTC. LHTC is not responsible for undelivered e-mail. There is no guarantee of message receipt or delivery. Return receipts may be requested, but there is no guarantee that the recipient's e-mail system will honor such requests. LHTC is not obligated to store the contents of customer's e-mail messages and is not obligated to produce copies of e-mail messages to customer. LHTC is not responsible for customer's personal files residing on LHTC systems. Customer is responsible for independent backup of all such data. Customer is hereby warned that some sites accessible via LHTC allow posting, viewing, retrieval, and/or electronic mailing of materials that may be considered obscene, offensive, inaccurate, incomplete, defamatory, harmful or objectionable. LHTC is not responsible for customer's inadvertent or deliberate access to such material and cannot prevent access of such materials.

REVISIONS TO POLICY
LHTC reserves the right to update or modify this Policy at any time upon thirty (30) days prior written notice. Notice of modifications to this Policy may be given by posting such changes to LHTC's homepage (www.lhtot.com), by electronic mail or by conventional mail.
